These Terms of Service (“Terms”) constitute a legally binding agreement between you and TactNib LLC (“TactNib,” “we,” “us,” or “our”), governing your use of our website at https://tactnib.com, our mobile application TactLog (formerly TactNib SmartTarget), and all related services, features, content, and products we provide (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

2. DESCRIPTION OF SERVICES

TactNib provides shooting sports technology solutions including:

Our Android application that provides:

Computer vision and AI-powered analysis of paper targets
Shot pattern detection and scoring
Performance tracking and analytics
Ballistic calculations (MOA, CEP, APOI)
Session management and historical data
Dry fire training capabilities
Export capabilities for target data

2.2 Physical Products

Paper targets for shooting sports
Related shooting sports accessories

2.3 Online Services

Target catalog and purchasing
User account management
Data synchronization across devices
Community features (forums, leaderboards, competitions) [when available]
News and educational content

3. ELIGIBILITY AND ACCOUNT REGISTRATION

3.1 Age Requirements

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years of age or that you are the parent or guardian of a minor and consent to such minor dependent’s use of the Services.

3.2 Account Creation

To access certain features of our Services, you must create an account. When creating an account, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security and confidentiality of your login credentials
Accept responsibility for all activities that occur under your account
Immediately notify us of any unauthorized use of your account

4. ACCEPTABLE USE POLICY

4.1 Permitted Use

You may use our Services only for lawful purposes and in accordance with these Terms. You agree to use our Services in compliance with all applicable federal, state, and local laws and regulations regarding firearms and shooting sports.

4.2 Prohibited Conduct

You agree not to:

Violate any applicable laws or regulations
Use the Services for any illegal or unauthorized purpose
Upload or transmit viruses, malware, or other harmful code
Interfere with or disrupt the Services or servers
Attempt to gain unauthorized access to any portion of the Services
Harvest or collect user information without consent
Engage in any conduct that restricts or inhibits anyone’s use of the Services
Submit false or misleading information
Impersonate another person or entity
Use the Services to promote violence or hatred
Upload content that infringes on intellectual property rights
Use automated systems or software to extract data from the Services
Circumvent any security features of the Services

5. USER-GENERATED CONTENT

5.1 Your Content

Our Services may allow you to upload, submit, store, send, or receive content (“User Content”). You retain ownership of any intellectual property rights in your User Content.

5.2 License to TactNib

By submitting User Content to our Services, you grant TactNib a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with operating and improving the Services.

5.3 Content Representations

You represent and warrant that:

You own or have the necessary rights to your User Content
Your User Content does not infringe any third-party rights
Your User Content complies with these Terms

5.4 Content Monitoring

We may, but have no obligation to, monitor, edit, or remove User Content that we determine in our sole discretion violates these Terms or may be offensive, illegal, or harmful.

6. INTELLECTUAL PROPERTY RIGHTS

6.1 TactNib Property

The Services and their entire contents, features, and functionality (including but not limited to all information, software, algorithms, text, displays, images, video, audio, design, selection, and arrangement) are owned by TactNib, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 TactLog Software

The TactLog application, including its source code, algorithms (including shot pattern detection, scoring algorithms, and ballistic calculations), object code, and user interface designs, are proprietary to TactNib and protected under applicable intellectual property laws.

6.3 Trademarks

“TactNib,” “TactLog,” and our logos are trademarks of TactNib LLC. You may not use our trademarks without our prior written permission.

6.4 Feedback

Any feedback, suggestions, or ideas you provide regarding our Services shall become the property of TactNib, and you hereby assign all rights in such feedback to us.

7. PURCHASES AND PAYMENTS

7.1 Products and Services

We offer various products and services for purchase, including:

Physical paper targets and accessories
Premium app features (if applicable)
Subscription services (if applicable)

7.2 Pricing and Payment

All prices are in U.S. dollars unless otherwise stated
We reserve the right to change prices at any time
Payment must be made through approved payment methods
You are responsible for any applicable taxes

7.3 Orders and Fulfillment

Order acceptance is at our discretion
We reserve the right to refuse or cancel orders
Risk of loss for physical products passes to you upon delivery to the carrier
Shipping times are estimates only

7.4 Refunds and Returns

Physical products may be returned in accordance with our Return Policy. Digital services and consumed products may not be eligible for refund.

8. THIRD-PARTY SERVICES AND LINKS

8.1 Third-Party Services

Our Services may contain links to third-party websites or services that are not owned or controlled by TactNib. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Your use of our Services is also governed by our Privacy Policy, available at https://tactnib.com/privacy-policy. By using our Services, you consent to our collection and use of your information as described in the Privacy Policy.

10. DISCLAIMERS

10.1 Service Availability

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TACTNIB EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Safety Disclaimer

TACTNIB DOES NOT PROVIDE FIREARMS SAFETY TRAINING OR INSTRUCTION. THE SERVICES ARE TOOLS FOR TRACKING AND ANALYZING SHOOTING PERFORMANCE ONLY.

Users are responsible for:

Following all applicable firearms safety rules
Complying with all local, state, and federal laws regarding firearms
Obtaining proper training and instruction in firearms safety
Using appropriate safety equipment
Ensuring safe handling and storage of firearms

10.3 Accuracy Disclaimer

While we strive for accuracy in our shot detection, scoring, and analysis features, we do not guarantee perfect accuracy. Environmental factors, image quality, and other variables may affect results. Official competition scoring should be verified through appropriate channels.

11. LIMITATION OF LIABILITY

11.1 Limitation

IN NO EVENT SHALL TACTNIB, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

11.2 Maximum Liability

IN NO EVENT SHALL TACTNIB’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO TACTNIB IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11.3 Jurisdictional Limitations

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. INDEMNIFICATION

11.1 Limitation

You agree to defend, indemnify, and hold harmless TactNib and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

Your violation of these Terms
Your use of the Services
Your User Content
Your violation of any rights of another party
Your violation of any applicable laws or regulations

13. TERMINATION

13.1 Termination by You

You may terminate your account at any time by:

Using the account deletion feature in the app
Contacting us at support@tactnib.com

13.2 Termination by TactNib

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to:

Breach of these Terms
Violation of applicable laws
Conduct harmful to other users or TactNib
Extended period of inactivity
Request by law enforcement or court order

13.3 Effect of Termination

Upon termination:

Your right to use the Services will immediately cease
We may delete your account and User Content
We are not obligated to retain or provide any User Content
All provisions of these Terms that should survive termination will remain in effect

14. DISPUTE RESOLUTION

14.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to contact us at support@tactnib.com to attempt to resolve any dispute informally.

14.2 Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in San Bernardino County, California.

14.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

14.4 Small Claims Exception

Either party may bring a suit in small claims court for disputes or claims within the scope of such court’s jurisdiction.

15. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in San Bernardino County, California.

16. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

Updating the “Last Updated” date
Sending an email notification (for registered users)
Posting a notice in the app

Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.

17. GENERAL PROVISIONS

17.1 Entire Agreement

These Terms constitute the entire agreement between you and TactNib regarding the Services and supersede all prior agreements and understandings.

17.2 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

17.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights under these Terms without restriction.

17.5 Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond its reasonable control.

By using our Services, you consent to receiving electronic communications from us. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

18. SPECIAL PROVISIONS FOR MOBILE APPLICATIONS

18.1 Mobile Application License

Subject to your compliance with these Terms, TactNib grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the TactLog application on devices you own or control.

18.2 Updates

We may from time to time develop updates, upgrades, or patches for the TactLog application. Such updates may be necessary for functionality, security, or compliance reasons.

18.3 Device Permissions

The TactLog application may request access to certain features of your device, including:

Camera (for target image capture)
Storage (for saving target data and images)
Location (for range location features, if enabled)
Network (for data synchronization)

You may control these permissions through your device settings.

19. EXPORT COMPLIANCE

You may not use, export, re-export, import, sell, or transfer the Services except as authorized by United States law and the laws of the jurisdiction in which the Services were obtained.

21. ACKNOWLEDGMENT

TactNib LLC reserves all rights not expressly granted in these Terms.
